TERMS ON SANSLIVE MEMBERSHIP PROGRAM AND SANSLIVE POINT (SLP)
1. INTRODUCTION TO SANSLIVE MEMBERSHIP PROGRAM
1.1 SANS 360 Sdn. Bhd., and/or, its related, associated or affiliated companies (hereinafter referred to either as “SANS”, “we” or “us”) as owners of Sansmart Online Platform (hereinafter also known as “Sansmart”) is making available the Sanslive Membership Program to you and/or any interested eligible persons to register and join as member, subject strictly to all terms and conditions as provided herein.
2. ACCEPTANCE OF THE TERMS OF MEMBERSHIP
2.1 Before or prior TO JOINING OR REGISTERING AS MEMBER OF SANSLIVE MEMBERSHIP PROGRAM, You or any INTERESTED PERSONS, are required to have read, accepted and agreed to all the terms ON SANSLIVE MEMBERSHIP PROGRAM AND/OR THE RELATED TERMS contained herein and/or any terms found, contained or provided on SANSMART, or provided by SANS.
2.2 Do not use or continue to JOIN, REGISTER OR MAINTAIN AS MEMBER OF SANSLIVE MEMBERSHIP PROGRAM, unless You, or any users,
2.2.1 have read, accepted and agreed to all the terms on MEMBERSHIP, and/or any of the RELATED TERMS which haVE been revised, amended, MODIFIED, varied or updated from time to time;
2.2.2 have continuously accepted and agreed to all terms on MEMBERSHIP, and/or any of the RELATED TERMS which haVE been revised, amended, MODIFIED, varied or updated from time to time, and AT ALL MATERIAL TIMES have not withdrawn such acceptance and agreement; and
2.2.3 where applicable, you have indicated that you have read, accepted and agreed in the method or manner as prescribed by SANS.
2.3 Your, or any INTERESTED PERSONS’, PARTICIPATION AS MEMBER OR SUBSISTING AS MEMBER OF SANSLIVE MEMBERSHIP PROGAM shall be deemed that you have read, understood, accepted and agreed to all the terms on SANSLIVE MEMBERSHIP PROGRAM, and/or any of the same which hAVE been revised, amended, MODIFIED, varied or updated from time to time.
2.4 Further, by your OR ANY INTERESTED PERSONS’, PARTICIPATION AS MEMBER OR SUBSISTING AS MEMBER OF SANSLIVE MEMBERSHIP PROGAM, you HAVE AGREED TO ABIDE, COMPLY, OBSERVE AND ADHERE TO ALL TERMS OF MEMBERSHIP and ANY RELATED TERMS, OR, ANY TERMS ON SANSMART OR PROVIDED BY SaNS.
3.1 Your personal data and privacy are important to SANS. Any use of personal data by SANS are subject to compliance of any applicable laws, and/or, provided terms or policy. In this regard, SANS is a registered user under the Personal Data Protection Act 2010.
3.2 Your joining as member and subsisting as member involves, the use or processing of your personal data, whether by necessity and/or incidentally so for the carrying out the Sanslive Membership Program and/or its related programs.
3.4 You have agreed to receiving promotional and marketing materials in whatsoever forms or method from SANS, and/or its affiliates or related parties.
PART 1: SANSLIVE MEMBERSHIP
4. REGISTRATION AND ELIGIBILITY
4.1 Any person who is eligible may apply to join as member of Sanslive Membership Program in the manner and mode as prescribed by SANS. The current manner and mode of application to join as member is made available by signing up and completing the application process on Sansmart Online Platform.
4.2 A person who is eligible to apply for registration as member is a person who complies, adhere or satisfy all the following: -
4.2.1 You are or have attained the age of eighteen (18) years old or age of majority;
4.2.2 In the event you are a minor, you are registering through or with the consent, supervision or guidance, of your legal guardian, and have indicated the same;
4.2.3 You are a citizen, or, permanent residence, or, citizen of other countries but domicile in Malaysia, Singapore, or countries in which Sansmart is made available;
4.2.4 You have provided true, accurate and valid information or data for registration, and update any information or data at soonest possible time available;
4.2.5 You have successfully registered as a Basic User on Sansmart Online Platform.
5. MEMBERSHIP LEVELS
5.1 The Sanslive Membership Program comprises of the following membership levels:-
[Note: Prior to becoming a Member, an applicant has to be registered as a Basic User. A Basic User is not one of the membership levels in strict senses, but a condition of eligibility to be registered as member.]
5.1.2 Premium Member
5.1.3 VIP Member
5.1.4 Gold VIP Member
5.1.5 Platinum Member
6. UPGRADE OF MEMBERSHIP LEVEL
6.1 Any valid and subsisting member may upgrade his membership level by earning, collecting or accumulate the required Sanslive Point by earning, collecting and accumulating the required Sanslive Point within the relevant period as provided below and in full compliance with all terms of membership contained herein.

Within a period of one (1) year earn a minimum 10,000 Sanslive Point
(eg, through spending of RM 10,000.00)
Within a period of one (1) year earn a minimum 5,000 Sanslive Point
(eg, through spending of RM 5,000.00)
Within a period of one (1) year earn a minimum 2,000 Sanslive Point
(eg, through spending of RM 2,000.00)
Within a period of one (1) year earn a minimum 100 Sanslive Point
(eg, through spending of RM 100.00)
(Note: For clarification, this is not a membership level in strict senses, but a condition of eligibility to be registered as member)
7. VALIDITY PERIOD OF MEMBERSHIP OR MEMBESHIP LEVEL
7.1 All membership, or, any of the membership level under the Sanslive Membership Program shall be valid for a period of one (1) year from, as the case may be, any of the following:-
7.1.1 the commencement date of the registration or joining as member; or,
7.1.2 the commencement date of the upgrade to any of the relevant applicable membership levels.
7.2 All validity of membership or membership levels, shall be subject to maintenance and renewal.
8. MAINTAINING VALIDITY AND AUTO RENEWAL
8.1 All members are required to maintain the validity of membership and/or its relevant applicable membership levels according to terms as provided herein.
8.2 Any member may maintain the validity of membership and/or its relevant applicable membership levels by earning, collecting and accumulating the required Sanslive Point within the relevant period as follows:-

Within a period of one (1) year earn a minimum 10,000 Sanslive Point to maintain as Premium Member
Within a period of one (1) year earn a minimum 200 Sanslive Point to maintain as Member
9. EXPIRED MEMBERSHIP, REACTIVATION AND REVIVAL
9.1 Any membership and/or membership levels which are not maintained, renewed or auto-renewed in accordance with terms as provided herein shall be rendered invalid, non-subsisting or expired.
9.2 Any member may apply to reactivate or revive his/her expired membership and/or membership level by earning, collecting and accumulating the required Sanslive Point within the relevant period as follows:-

Within three (3) months, earn a minimum 100 Sanslive Point to reactivate as Member
10. PROMOTION, INCENTIVE AND BENEFIT
10.1 A member is entitled to use and shop on Sansmart.
10.2 Each member of any relevant applicable membership level is entitled to the following:-
10.2.1 promotion, benefit and/or incentive, which shall be presented in the form of rewards, coupons, bonuses, vouchers, discounts, redemptions, points, promo codes, as the case may be, granted to the respective membership level, as made available on Sansmart;
10.2.2 participation of the Sanslive Point reward or redemption programs granted to respective membership level, as the case may be, as made available on Sansmart;
10.2.3 enjoy available promotion, benefit and/or incentives on birthday, campaigns, festivals or seasons, as the case may be, as made available on Sansmart.
10.3 Any of the above entitlements, promotion, benefit and/or incentive, with its particulars and details are shown or shall be displayed on Sansmart, especially in the members section of Sansmart.
10.4 SANS maintains the sole and exclusive rights to amend, vary, update, change, remove, delete, discontinue, suspend, impose conditions whether with or without any prior notice on any of the following:-
10.4.1 any promotion, incentive and/or benefit;
10.4.2 operation of rewards, bonuses, coupons, vouchers, discounts, redemption, promo codes, or points system;
10.4.3 any terms of the members contained herein.
10.5 All members hereby waive all rights, claims or actions against SANS and/or its associated, related and affiliated company for any damage, loss, injury suffered arising from or due to carrying out of any promotion, benefit and/or incentive.
11. CANCELLATION OF MEMBERSHIP
11.1 SANS reserves the exclusive right and discretion to cancel the membership of a member, or, impose relevant condition or requirement, or, make variation or changes to the membership terms without giving any prior notice or explanation.
11.2 SANS reserves the exclusive right and discretion to terminate any membership or the Sanslive Membership Program or any programs thereunder, without giving any prior notice or explanation.
11.3 The examples in which SANS may cancel membership arises commonly, but not limited to, the following: -
11.3.1 long dormant or inactive membership;
11.3.2 member in abuse of the use, or, making illegal or unlawful use of the membership or Sansmart;
11.3.3 member using membership or Sansmart for wrongful purposes or other than the purpose they were created;
11.3.4 member infringing rights or entitlement of 3rd parties;
11.3.5 member’s action, inaction or conduct, damages the goodwill and reputation of SANS or Sansmart.
12. VOLUNTARY TERMINATION BY MEMBERS
12.1 Any members may voluntarily terminate his/her membership by sending a written request to Customer Service, details of which may be obtained from Sansmart.
13. GENERAL COVENANT AND UNDERTAKING AS MEMBER
13.1 All members hereby covenant, represent and undertake as follows: -
13.0.1 adhere, comply and observe to all laws, rules, regulations, direction, directive, regulatory or supervisory standard operating procedures;
13.0.2 do conduct oneself with honesty, dignity and integrity in the use of Sansmart, dealing with other members or customers of Sansmart;
13.0.3 not to violate, breach, infringe any rights, entitlement or benefit of any other member or customers of Sansmart;
13.0.4 adhere, comply and observe all terms which are prescribed by SANS and/or found on Sansmart;
13.0.5 not to damage or cause disrepute to the reputation and goodwill of SANS or Sansmart;
13.0.7 not to make fraudulent statement, misrepresentation, untrue or inaccurate statements as member or in connection to SANS or Sansmart;
13.0.8 to report and cooperate with SANS and not to withhold any disclosure on any investigation or any wrongful conduct or malpractice by other members;
13.0.9 not to participate in any wrongful or unethical conducts or activities as member, or in connection to activities on SANS or Sansmart.
PART 2: SANSLIVE POINT (SLP)
14. SANSLIVE POINT A LOYALTY PROGRAM
14.1 Sanslive Point (also known as “SLP”) is a loyalty program which is within or under the Sanslive Membership Program.
14.2 Any person who wish to be entitled to Sanslive Point is required to be a registered, valid, subsisting and non-expired member of the Sanslive Membership Program subject to terms and conditions as provided herein.
15. EARNING SANSLIVE POINT
15.1 A member may earn, redeem or be rewarded with a prescribed number of SLP by the following manners:-
15.1.1 shopping or making purchases on Sansmart;
15.1.2 participation on a promotion, marketing or sales campaign;
15.1.3 membership entitlements by SANS (for example, free SLP on birthday);
15.1.4 participating in any activities which provides for giving out of SLP (eg, participating in events, engaging in certain activities such as making daily check in).
15.2 The number of SLP that may be rewarded to a member are as shown or displayed on Sansmart, more specifically with the shopping items.
15.3 The members are encouraged and undertake to check on the numbers of SLP that may be rewarded to the members on each and every purchase on Sansmart.
15.4 All SLP does not have any cash value and shall not be claimed or exchanged in the form of cash by any member.
15.5 All SLP can only be used in the provided and prescribed manner by SANS, only on Sansmart Online Platform and not for any other purposes.
15.6 SANS reserves the exclusive right and discretion to decide and determine how SLP may be earned, collected or cumulated by a member on Sansmart without giving any prior notice or explanation.
16. USING SANSLIVE POINT
16.1 A member may use his/her cumulated SLP as incentive and benefit which is as prescribed or made available in Sansmart.
16.2 A member may use his/her cumulated SLP whilst shopping and making purchases on Sansmart:-
For illustration purposes, as and when where made available, the SLP may be used for as follows:-
(a) To pay a lesser sum in cash for the purchase price of a shopping item;
Eg, The Purchase Price of a product is RM 100.00. John pays RM 50.00 in cash and submits 50 SANSLIVE POINT to buy and claim the product.
(b) Without making any payment in cash for Product, and claim a product item;
Eg, The Purchase Price of a product is RM 100.00. John submits 100 SANSLIVE POINT to claim the Product and pays RM 0.00 in cash.
16.3 A member may also use the SLP to participate in a promotion, campaign or activities (eg a game etc).
16.4 The SLP may be capped at a minimum number for redemption or use. In such case, the member must have the relevant minimum number of SLP before using the SLP.
16.5 The SLP may be capped at a maximum number of cumulated SLP in which a member may hold, collect or accumulate. In such case, the member should use up the SLP before the member could continue to accumulate more SLP.
16.6 Any member shall be required to maintain a valid, subsisting, non-expired membership before the member could use his/her SLP or be entitled to the benefit or incentive of the SLP.
16.7 The SLP are not transferrable to any other members, non-member or to any third party.
16.8 SANS reserves the exclusive right and discretion to decide or determine how the SLP may be used by the Member on Sansmart without giving any prior notice or explanation.
17. MANAGING SLP
17.1 Members may check, view or manage, SLP through the designated section (eg Member section) on Sansmart, which shows the total collected or cumulated SLP, the total use and the remaining balance, where available.
18. VALIDITY OF SLP
18.1 All SLP are valid for a period of two (2) years only, commencing from the date on which the SLP is created for giving to the Member, or rewarded to the Member, or, collected or earned by the Member.
18.2 The SLP automatically expired on the end of the two (2) years period as prescribed above. Thereafter, an expired SLP cannot be revived, reactivated or reclaimed back by the Member.
PART 3: OTHERS
19. Waiver and indemnity
19.1 By you having registered and/or subsisting as member, you waive all rights to take action against SANS for any liability arising from to your membership; membership entitlements, rewards and incentives, or anything related to the same.
19.2 By you having registered and/or subsisting as member, you shall indemnify SANS for any liabilities loss damage and injury caused to SANS arising thereof or related to the same.
19.3 By you having registered and/or subsisting as member, you waive all rights to take action against SANS for any liability arising from statement, representation or warranties from SANS or on Sansmart.
20.1 No member shall assign or novate any rights, benefit, interest arising from the terms herein to any third party without the written consent or approval by SANS.
21. CHANGES AMENDMENTS VARIATION
21.1 All the terms, conditions and provisions contained herein are subject to changes, amendments, modification, deletion, removal or variation by SANS, from time to time, or, at any time without providing any reason or explanation whatsoever.
22. INTERPRETATION AND MEANING
The following words shall have the following meanings unless the context otherwise states:-
“Member” or “Membership”
means the Sanslive Membership Program referred to herein and administered by SANS;
means SANS 360 Sdn. Bhd., and/or, its related, associated or affiliated companies;
“Sansmart”, “Sansmart Online Platform” or
means the software applications and/or content application which includes desktop or mobile application (mobile apps) and website of sansmart.co
“SLP” or “Sanslive Point”
means the Sanslive Point as provided under Part 2 of this terms of member under Sanslive Membership Program.
